Supreme Court decision on Judges' appointment in Pakistan

Date : October 23, 2010, Saturday.

The Newspapers of October 22, 2010, Friday told the story of the reasons of point of break or stop between the dispute between Judiciary and Government in Pakistan over the appointment of Judges. The supreme court of Pakistan returned back the Article 175 of the constitution of Pakistan to the parliament to reconsider it in the National Assembly and Senate and then send it again to the President of Pakistan for approval. Media says that the parliament will reconsider on the article 175 in closed room meetings of the parliamentary committee of the National Assembly and will send its decisions after holding several meetings to the Prime Minister of Pakistan. Article 175 is regarding the appointment of Judges in the High Courts and in the Supreme Court of Pakistan. Supreme Court has not announced its detailed decision on 18^th Amendment but issued a short interim order to sending back article 175 to the parliament for reconsideration and said to issue the final decision of the case in last week of January 2011. Chief Justice Supreme Court of Pakistan Justice Iftikhar Muhammad Choudhry announced the short interim order on 18^th constitutional amendment on Friday consisting on 18^th pages. I appreciate, support and favour this decision of Supreme Court of Pakistan. Whole the nation was waiting for this decision on Friday October 21. Chief Justice Iftikhar Choudhry has provided the opportunity to the government and to the parliament specially to run government with the mutual understanding and the consensus with the Judiciary. Prime Minister Yousuf Raza Gilani has also said in his last address to the nation that his government is agreed to consult further with judiciary and even with the military. Chief Justice said in his short interim order that he (the Chief Justice) of supreme court and the chief justices of all high courts including the chief justice of Federal Shariat Court would decide and recommend the names of judges for appointment in the meetings of Judicial Commission under the presided over by the Chief Justices of the respective courts and will send these names to the President of Pakistan. The supreme court said in its order that the final decision and recommendation of the Chief Justice Supreme Court will be given preference by the President of Pakistan before issuing the orders of appointment of the judges in high courts, supreme court and in the federal shariat court. If the parliamentary committee of the government will not satisfied on the recommendations of the Chief Justice of Pakistan on the names of the judges for appointment then the Prime Minister of Pakistan should have to tell and explain before the Chief Justice and before the President of Pakistan those strong and legal reasons for opposing the recommendations of the Chief Justice of Pakistan. The petition against the decision of the parliamentary committee might be admitted and submitted in the court. The Chief Justice said in his order that the immediate appointments of judges in the high courts and in supreme court will be made according to the article 175-A of the constitution of Pakistan. The Supreme Coutrt has said in its short interim order that the promulgation of article 175-A will effect the independence of judiciary so it is being sent back to the parliament for reconsideration correction and amendment. This article is currently saying that the Chief Justice of Pakistan has only a vote in the Judical Commission and the Parliamentary Committee of the government is authorized and righteous to reject the recommendations of the Judicial Commission of the supreme court of Pakistan. I support and favour this opinion and decision of the supreme court of Pakistan.
